Senator Al Franken demands answers from Carrier IQ

The Register is reporting, in its own inimitable style, that Sen. Franken wants Carrier IQ to explain how its software is not violating US wiretap laws.
The EFF has a helpful list of potentially applicable electronic privacy laws posted here. Note that the CFAA has a private right of action for any person who suffers at least $5000 in damages as a result of the malicious software.
California has an interesting statute that, based on Trevor Eckhard’s research, (link to the google cache because his site is down) the Carrier IQ application obviously violates.
